1. Object

These General Conditions (together with the order form and other elements referred to therein) establish the conditions governing the use of the website and the Online Store of Bazaarspoint.com and the purchases of products through it (hereinafter, the "Conditions").

Please read the Conditions carefully before using the Online Store and its respective website page (hereinafter collectively referred to as the "Online Store"). By using the Online Store or placing an order or purchase through it, the customer is accepting these Conditions and is bound by them. Therefore, if you do not agree with these Conditions, the customer should not use the Online Store.

2. Our Data

Bazaarspoint.com belongs to Panorama e Rotinas, Lda., a limited liability company headquartered at Praça Bernardo Santareno, nº 3 - 8ºA, 1900-098 Lisbon, registered at the Commercial Registry Office under the unique registration and corporate identification number 514 046 732, hereinafter referred to as Panorama e Rotinas.

3. Personal Data

The information or data provided by the customer will be processed in accordance with the provisions of the Information on the Processing of Personal Data [Privacy Policy]. By using the Online Store, the customer declares that all information or data provided is true and corresponds to reality.

4. Use of the website and Online Store

By using the Online Store and/or placing orders through it, the customer undertakes to:

• Use this website only to make legally valid inquiries or orders;
• Not to place any false or fraudulent orders. If, reasonably, we consider that an order of this nature has been placed, we will be authorized to cancel it and inform the competent authorities;
• Provide us with your email address, postal address, and/or other contact details, truthfully and accurately, also consenting to the use of the information provided for us to contact the customer, in accordance with the Information on the Processing of Personal Data [Privacy Policy]. If you do not provide us with all the necessary information, we will not be able to process your order, as this data will be necessary to coordinate delivery or inform you about any relevant occurrences regarding your order.

When placing an order through the Online Store, the customer declares to be over 18 years of age and to have legal capacity to enter into contracts.

5. Service Availability

The products presented in the Online Store are only available for delivery in the following countries: Portugal (Mainland and Islands), Germany, Austria, Belgium, Bulgaria, Croatia, Denmark, Slovakia, Slovenia, Spain, Estonia, Finland, France, Greece, Netherlands, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Poland, Czech Republic, Romania, and Sweden.

Delivery times: After confirmation of receipt of payment, we will prepare your order and schedule collection for the next working day, unless there is a stock shortage. Once your order is in transit, you will receive an email from the carrier with the number to track your order. Delivery time after collection: Portugal (Mainland and Islands) and Spain - Delivery in 24-72 business hours. Germany, Austria, Belgium, Croatia, Denmark, Slovakia, Slovenia, Estonia, Finland, France, Greece, Netherlands, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Poland, Czech Republic, and Sweden - Delivery in 4-8 business days.

6. Contract Conclusion

The information contained in these Conditions and the details included in the Online Store do not constitute a contractual offer, but rather an invitation to contract. There will be no contract between bazaarspoint.com and the customer regarding any product until the customer's order has been expressly accepted by bazaarspoint.com. If the customer's offer is not accepted and payment has already been debited from your account, the amount thereof will be fully refunded.

To place an order, you must:

• Choose the category/brand/product you wish to purchase from the catalog. View the product(s) of interest. Click on the item to access its details and to enlarge the image;
• Choose the different options for the item and you can add it to your shopping cart. Then you can choose to continue adding more products or proceed with your order;
• You should provide the contact email, which will be used to update the different states of your order;
• You should indicate the information for shipping and delivery;
• The carrier and shipping cost will be presented;
• Select a payment method: Credit or Debit Card and the information about it;
• Confirm your order and then you will receive an email acknowledging the confirmation of your order with the status of "Payment Made" and the status of Order Processing "Awaiting Shipment".

If the customer does not receive the Order Confirmation email, it is requested that you contact bazaarspoint.com through the following contacts info@bazaarspoint.com so that this notification can be resent to the customer's email address.

7. Product Availability

All orders for products are subject to their availability. If there is any difficulty regarding the supply of products or if there are no items in stock, we reserve the right to provide you with information about substitute products of equal or higher quality that you may order. If you do not wish to order any of these substitute products, we will refund the amount you have already paid.

8. Inability to Complete an Order

We reserve the right to withdraw any product from the Online Store at any time and to remove or modify any material or content therein. Although we make every effort to always fulfill all orders, exceptional circumstances may arise that require us to refuse to fulfill an order after we have sent the Order Confirmation, so we reserve the right to do so at any time if we deem it necessary.

9. Product Information, Prices, and Contents

Bazaarspoint.com reserves the right to modify, without prior notice and at any time, the commercial information and offer presented on: products, prices, promotions, commercial conditions, and services.

The images illustrating each product on bazaarspoint.com may differ from the product subsequently delivered, and these same products are also subject to stock shortages.

Despite the efforts of bazaarspoint.com, some products may present an inaccurate price, which is why the company checks prices whenever it processes orders. If the price is higher, bazaarspoint.com will inform the customer of this situation by email and will await your decision to accept the new price or cancel the order within 15 days from the date the email was sent. If we are unable to contact the customer, the order will be canceled, and the amount paid will be fully refunded. Under Portuguese law, all prices shown on bazaarspoint.com include the respective VAT rates in force, unless otherwise indicated.

10. Transfer of Risk and Ownership of Products

The risks of the products will be borne by the customer from the moment of delivery. The customer will acquire ownership of the products when we receive full payment of the amounts due for them, including shipping costs, or at the time of delivery if this date is later.

11. Price and Payment

The price of each product will be the one stipulated, at any time, on the Online Store, except in cases of obvious error. Although we try to ensure that all prices on the page are correct, errors may occur. If we detect an error in the price of any of the products you have ordered, we will proceed in accordance with clause 9.3.

We are not obligated to provide you with any product at the incorrect lower price (even if we have sent the Order Confirmation) if the error in the price is manifest and unequivocal or if it could have been reasonably recognized by the customer as an incorrect price.

Prices may be changed at any time, but (except as set forth above) such changes will not affect orders for which we have already sent an Order Confirmation.

12. Intellectual Property

The customer acknowledges and accepts that all copyright, trademarks, and other intellectual property rights in the materials or content provided as part of the Online Store are ours or have been licensed to us for our use. The customer may only use such material as expressly authorized by us or by the licensors of such material. This does not prevent you from using this Online Store to the extent necessary to copy the information about your order or the data of the Contract.

13. Viruses, Hacking, and Other Cyber Attacks

You must not misuse this Online Store by knowingly introducing viruses, Trojans, logic bombs, or any other technologically harmful or damaging material. You must not gain unauthorized access to this Online Store, the server on which this page is located, or any server, computer, or database related to our Online Store. You agree not to attack this Online Store through a denial-of-service attack or a distributed denial-of-service attack.

Failure to comply with this clause may constitute offenses under applicable law. We will inform the competent authorities of any breach of said legislation and cooperate with them to discover the attacker's identity. In case of breach of this clause, you will also cease to be authorized to use this Online Store.

We will not be liable for any loss or damage caused by a denial-of-service attack, virus, or any other technologically harmful or damaging program or material that may affect your computer, computer equipment, data, or materials as a result of using this Online Store or downloading content from it or the content to which it redirects.

15. Written Communication

We will contact the customer by email or provide information through notices posted on this Online Store. For contractual purposes, the customer agrees to use this electronic means of communication and acknowledges that all contracts, notices, information, and other communications sent electronically comply with the legal requirement that such communications be made in writing. This condition does not affect the rights recognized by law.

16. Notifications

Customer notifications must be sent to the email info@bazaarspoint.com. In accordance with the provisions and unless otherwise indicated, we will send you notifications by email or to the postal address provided when you placed your order.

Notifications will be considered received and correctly made at the same moment you access our Online Store, 24 hours after sending an email, or three days after the date of franking of any letter. To prove that the notification was made, it will be sufficient, in the case of a letter, to prove that the address was correct, that it was properly stamped, and that it was duly delivered to the post office or a mailbox, and, in the case of an email, that it was sent to the email address specified by the recipient.

17. Assignment of Rights and Obligations

The Contract is binding on the customer and us, as well as our respective successors, assignees, and heirs.

The Customer may not transmit, assign, encumber, or otherwise transfer the Contract or any of the rights and obligations arising therefrom without our prior written consent.

Bazaarspoint.com may assign, transfer, encumber, subcontract, or otherwise transfer a Contract or any of the rights and obligations arising therefrom at any time during the term of the Contract. To avoid any doubt, these transfers, assignments, or other transfers will not affect the rights recognized by law that the customer, as a consumer, has, nor will they affect or limit in any other way the express or implied warranties that may have been granted.

18. Force Majeure

For the purposes of these Conditions, force majeure events are considered to be unforeseeable events whose effects occur independently of the will or personal circumstances of bazaarspoint.com, which, due to their severity or consequence, make it impossible to fulfill an obligation and whose effects it would not be reasonably expected for bazaarspoint.com to circumvent or avoid.

Force majeure may include, if the requirements of the previous number are met, namely, earthquakes, floods, fires, epidemics, sabotage, strikes, international embargoes or blockades, acts of war or terrorism, riots, and governmental or injunctive administrative determinations.

Force majeure exempts bazaarspoint.com from liability for non-compliance with one or more obligations arising from the Contract, for the period during which the reasons for force majeure persist. Bazaarspoint.com will benefit from an extension of the deadline to fulfill such obligations for a period of time equal to the duration of the force majeure reasons and must use all reasonable means to end the force majeure reasons or to find a solution that allows it to fulfill its obligations arising from the Contract.

19. Interpretation

The headings of the clauses of the Conditions are included for mere convenience, not constituting support for the interpretation or integration thereof.

Unless the context otherwise requires, any reference made in these Conditions to a legal or contractual provision includes the amendments to which it has been and/or will be subject.

These Conditions, and all documents incorporated therein, constitute the entire agreement between the Parties, replacing all terms and conditions arising from negotiations or proposals preceding it, and no suppression, addition, or modification of any of the clauses of these Conditions will be valid unless it is written and signed by one or more duly authorized representatives of both Parties.

If any provision of these Conditions is held to be void or in any way invalid, ineffective, or unenforceable by a competent entity for this purpose, such nullity, invalidity, ineffectiveness, or unenforceability shall not affect the validity of the remaining provisions.

20. Miscellaneous Provisions

The deadlines referred to in these Conditions are counted in consecutive calendar days, unless expressly stated otherwise, in which case Saturdays, Sundays, and national holidays are not counted.

The non-exercise or late or partial exercise of any right that bazaarspoint.com may have under this contract does not imply a waiver of that right or prevent its subsequent exercise.

21. Amendment of These Conditions

Bazaarspoint.com has the right to amend these Conditions at any time. The customer is subject to the principles and terms in force at the time of their order, unless the law or competent authority impose any changes to them.

22. Applicable Law and Jurisdiction

The use of our Online Store and the contracts for the purchase made through this page are governed by Portuguese law.

Any disputes that arise or are related to the Online Store will be subject to the jurisdiction of the Courts of the District of Lisbon.
